In New Legislative Sessions, State Legislators Push for Bipartisan AI Regulations

WASHINGTON, D.C. — As 2025 legislative sessions get underway in states across the country, legislation regulating generative AI — both for election-related communications and for non-consensual intimate deep fakes — continues to be a top priority for legislators of both parties.

State progress on the issue of election-related deepfakes has been proactive and bipartisan — in the 2024 legislative session, 41 states across the country and Washington, DC introduced legislation, and 18 states enacted laws regulating deepfakes in elections. In the 2025 legislative session, the momentum has not let up —  20 states have already introduced legislation on the topic.

With rising public awareness of what AI-generated intimate deepfakes are and the long-term harm that victims — mostly young girls — experience, states are making rapid progress on legislation to protect people. So far this session, 18 states have introduced over 70  pieces of legislation to regulate the creation and dissemination of so-called “deepfake porn.”

Public Citizen is tracking these bills in our election deepfakes legislation tracker and our intimate deepfakes legislation tracker, both of which are updated regularly.

“State legislators across the country affected real, bipartisan change in 2024 when they led the charge to tackle the emerging threat of AI deepfakes in elections and safeguard our democracy,” said Ilana Beller, a democracy advocate with Public Citizen. “In 2025, it appears that no momentum is being lost — which is critical because the technology is continuing to develop at lightning speed. Our hope is that by the end of 2025, all or nearly all U.S. states will have laws on the books protecting people from these abuses of generative A.I.”

Public Citizen is also closely monitoring and advising on state legislation to regulate the use of AI chatbots, including pushing for requirements for consumers to be informed when they are interacting with a chatbot or similar AI technologies.
