U.S. Security Associates (USSA) is a private security guard company that provides guards for various businesses in California. A group of guards employed by USSA filed suit, claiming various violations of California labor law, including a denial of meal breaks to which the employees are entitled by statute and regulation. A federal district court certified the meal-break class, and the court of appeals affirmed. USSA petitioned the Supreme Court to review the case. In June 2014, Public Citizen filed the brief in opposition defending the employees’ right to proceed as a class because the nature of the questions they raise under California law are susceptible to resolution on a classwide basis and common issue predominate over individual ones. In October 2014, the Supreme Court denied the petition.
