Knisley v. Medtronic, Inc.
In this case, we served as Supreme Court co-counsel for the plaintiff in a petition for certiorari that posed the question whether the preemption provision of the Medical Device Amendments to the Food, Drug and Cosmetic Act preempts claims seeking damages for injuries caused by medical devices that received premarket approval from the Food and Drug Administration. The Court denied the petition but resolved the question in a later case. See Riegel v. Medtronic.
