Farm Labor Organizing Committee v. U.S. Department of Labor
On June 7, 2018, Farm Labor Organizing Committee (FLOC) submitted a Freedom of Information Act (FOIA) request to the U.S. Department of Labor (DOL) for records related to the agency’s investigations of agricultural employers who grow and sell tobacco. DOL denied the request in full, claiming that the responsive records are confidential and exempt from disclosure. FLOC submitted an administrative appeal, but DOL did not respond.
Representing FLOC, we filed suit in March 2020 challenging DOL’s refusal to produce the requested records. DOL then changed its position and produced 1,200 pages of responsive records, with numerous redactions. The parties then filed cross-motions for summary judgment concerning DOL’s redactions under exemption 4 of information identifying the purchasers of tobacco grown by employers found to have violated employment laws. On July 28, 2025, the court issued an opinion holding that DOL had failed to meet its burden to show that the growers who submitted the information at issue treat the identity of the tobacco purchasers as confidential and would be harmed by its release. The court declined to rule, however, on whether the companies that purchased the tobacco treat the identity of their contract growers as confidential and would be harmed by the release of information that reveals that relationship, and ordered further briefing on whether, in conducting an exemption 4 analysis, the court can consider how a non-submitter treats the withheld information.
