The Garden Grove Unified School District filed a petition seeking review of a decision of the Ninth Circuit affirming an award of reimbursement under the Individuals with Disabilities Education Act (IDEA) to the guardian of a disabled student who paid for educational services from a nonpublic agency after the District violated the Act by failing to provide the student with a free appropriate public education. The District claims that the guardian is not entitled to full reimbursement because the services provided by the nonpublic agency met many, but not all, of the disabled student’s needs.
On September 27, 2011, we filed a brief in opposition, arguing that the Court should deny the petition because the Ninth Circuit faithfully applied the applicable reimbursement standard to the record in the case, and the decision of the Ninth Circuit does not conflict with the decision of any other court.
