Wyoming v. Dept. of Agriculture || Colorado Mining Assn. v. Dept. of Agriculture

In this case, the U.S. Court of Appeals for the Tenth Circuit upheld a Forest Service regulation restricting the building of new roads and commercial logging operations in roadless areas of the National Forests. The State of Wyoming and a mining industry organization filed petitions for certiorari asking the Supreme Court to overturn the rule on a number of grounds, including claimed conflicts with the Wilderness Act and the National Forest Management Act as well as violations of the National Environmental Policy Act. Public Citizen, together with attorneys from Earth Justice, were co-counsel on a brief in opposition filed on behalf of conservation groups that intervened in the lower courts to defend the rule. The Supreme Court denied review.
