A Dallas-area real estate company sued an anonymous Yelp user who posted critical comments about it on Yelp, claiming defamation, and issued a Texas subpoena to identify the critic; the subpoena was served on Yelp’s registered agent in Dover, Delaware. After Yelp objected, the company moved to compel; we have opposed the motion on the ground that Yelp can only be subpoenaed in California, and that the real estate not only had not shown that anything said about it is false, but could not possibly succeed in its defamation suit because the action was filed more than a year after the criticism was posted, and hence is barred by the statute of limitations.
