Public Citizen v. U.S. Equal Employment Opportunity Commission (FOIA)

On June 16, 2025, Public Citizen submitted a Freedom of Information Act (FOIA) request to the U.S. Equal Employment Opportunity Commission (EEOC) seeking records related to letters sent to 20 law firms by EEOC on March 17, 2025. The letters concerned the law firms’ diversity, equity, and inclusion (DEI) policies. Four of the law firms entered into settlement agreements with EEOC. Public Citizen requested copies of emails and attachments related to the letters, and all records that mention or discuss the agreements. EEOC denied the request in part and we filed an administrative appeal. The deadline for EEOC to respond to the appeal has passed, as has the deadline for EEOC to produce the remainder of the requested records. Accordingly, we filed suit in the U.S. District Court for the District of Columbia to compel EEOC to produce the requested records.
