Public Citizen v. FMCSA (FOIA)
In 2025, the Federal Motor Carrier Safety Administration (FMCSA) conducted a review of state records on issuance of “non-domiciled” commercial driver’s licenses – that is, commercial driver’s licenses issued to non-citizen drivers. FMCSA then issued preliminary findings that many states were not compliant with federal standards. On November 26, 2025, Public Citizen submitted a Freedom of Information Act (FOIA) request to FMCSA, seeking FMCSA’s correspondence with state departments of motor vehicles concerning non-domiciled commercial driver’s licenses. After the agency failed to produce the requested records, we filed suit.
