Public Citizen v. Department of Labor (EO 13771 Records)
In April 2017, Public Citizen submitted Freedom of Information Act requests to three components within the Department of Labor — the Mine Safety and Health Administration, the Occupational Safety and Health Administration, and the Office of the Secretary – seeking records related to implementation of Executive Order 13771 and guidance from the Office of Management and Budget related to that Executive Order. After months during which Public Citizen received no response from DOL, Public Citizen filed suit seeking disclosure of the requested records. The parties agreed on a production schedule requiring DOL to produce records on a rolling basis. After DOL produced responsive records, Public Citizen dismissed the case.
