Public Citizen v. Department of Health and Human Services (2026)

In the fall of 2025, President Trump announced that the Department of Health and Human Services (HHS) and the Department of Commerce (DOC) had negotiated deals with several pharmaceutical companies. He claimed that the deals would lower drug prices and guarantee that the companies would provide the United States “most-favored nation” pricing. Public Citizen submitted Freedom of Information Act (FOIA) requests to HHS and DOC, seeking copies of the agreements. In January 2026, after HHS and DOC failed to produce the requested records, Public Citizen filed suit under FOIA.
