Philip Morris, Inc. v. Reilly

On behalf of Public Citizen and 13 other public health groups, we filed an amicus brief in the First Circuit Court of Appeals supporting the Massachusetts requirement that tobacco companies disclose the ingredients in their products. The court held, however, that the law constituted an unconstitutional taking of property because public disclosure of the ingredients lists would expose the tobacco companies’ trade secrets.
