National Fair Housing Alliance v. CFPB

Nearly 50 years ago, Congress enacted the Equal Credit Opportunity Act (ECOA) to eradicate credit discrimination against groups of people, like women and Black Americans, who had systematically been denied access to financial independence and opportunity. In a rule issued in April 2026,  the Consumer Financial Protection Bureau (CFPB) upended decades of consistent regulatory implementation of ECOA by issuing a new rule that dismantles some of the statute’s fundamental protections.

Representing the National Fair Housing Alliance, Rise Economy, and fair lending compliance firms BLDS, LLC and SolasAI, we filed suit in May 2026 to challenge the new rule. Public Citizen Litigation Group is working with co-counsel at Relman Colfax, PLLC, and Democracy Forward.
