Hunger Free America v. Rollins

For more than 30 years, Congress has required USDA to contract with a nonprofit organization to serve as an “information clearinghouse” for food assistance resources. Since 2014, Hunger Free America has held the contract for establishing and maintaining the clearinghouse, helping tens of thousands of individuals and families access food banks, soup kitchens, and government programs such as the Supplemental Nutrition Assistance Program (formerly known as food stamps), the Special Supplemental Nutrition Program for Women, Infants, and Children, and the Summer Food Service Program.

In May 2025, without any explanation or warning, USDA informed Hunger Free America that it would not be exercising the option for the second year of the 5-year contract. Since then, USDA has taken no action to fulfill its statutory obligation to ensure that a nonprofit anti-hunger organization maintains the clearinghouse.

Representing Hunger Free America, we filed suit to challenge USDA’s decision not to fund the clearinghouse. The complaint alleges that USDA’s action is arbitrary, capricious, and contrary to law.
