Gill v. Department of Justice

In May 2026, the Department of Justice, led by acting attorney general Todd Blanche, announced the establishment of a so-called “Anti-Weaponization Fund” to evaluate and pay claims for what the agreement calls “Lawfare” and “Weaponization.” An order signed by Blanche provides for a commission of five individuals appointed by the Attorney General and removable by the President to carry out the Fund’s responsibilities, authorizing the Fund to award up to $1.776 billion as compensation, and setting an end date of December 15, 2028, for completion of Fund activities. The Fund is based on a settlement of purported claims filed by Donald Trump against the Department of Justice, the IRS, and other government agencies.

Allison Gill is a former employee of the Department of Veterans Affairs (VA) and a founder of the Mueller, She Wrote podcast. Due to her criticism of President Trump on her podcast, Ms. Gill believes that she was subject to “Lawfare” and “Weaponization” during the first Trump term, which led to her termination from the VA in 2019.

On May 27, 2026, Public Citizen Litigation Group filed suit in to challenge the legality of the Fund on behalf of Gill, who has a potential claim for compensation from the Fund due to actions taken against her by the Trump administration. The lawsuit seeks a court order invalidating the Fund on the ground that the government’s actions in establishing the Fund constitute a rule under the Administrative Procedure Act (APA) that was issued without following the APA’s notice-and-comment requirements.
