Collateral Order Doctrine: Corporate Responsibility / Human Rights

This case asked whether the collateral order doctrine should be expanded to allow a private U.S. corporation sued in a federal district court for its tortious actions to appeal from an order that, in response to Statements of Interest by the Executive Branch notifying the court of potential U.S. foreign policy concerns, grants in part and denies in part the corporation’s motion to dismiss the plaintiffs’ claims under the political question doctrine.

Bonnie Robin-Vergeer of Public Citizen was co-counsel for the respondents at the cert stage, and the Supreme Court denied cert.
