Environmental Defense Fund v. Chao/Buttigieg

Public Citizen and eight other organizations have sued the Secretary of Transportation, the Department of Transportation, and the National Highway Traffic Safety Administration (NHTSA) over NHTSA’s unlawful issuance of regulations to preempt California’s authority to set greenhouse gas emissions standards for automobiles. After the Biden Administration took office and NHTSA issued new standards that reverse the rollback, we dismissed the action without prejudice.
