Dusenbery v. United States

In this case, decided by the Supreme Court in January 2002, Public Citizen argued that the federal government violated the Due Process Clause of the Fifth Amendment by failing to give actual notice to an inmate in its own prison system before it forfeited the inmate’s property for its own benefit. In a 5-4 decision siding with the government, the Court held that the government’s practice of sending a notice by certified mail to the prison where the inmate was incarcerated satisfied due process.
