American Public Health Ass’n v. EPA

In 2009, the Environmental Protection Agency (EPA) reached the science-based conclusion that greenhouse gases threaten public health and welfare.  That determination, known as the endangerment finding, gave the EPA the authority and duty to regulate greenhouse gases.

In a rule published on February 18, 2026, the EPA rescinded the endangerment finding and repealed its greenhouse gas emission standards. The rescission hamstrings the agency’s ability to address greenhouse gases and will have a devastating impact on the climate and public health. Together with other health and environmental organizations, we immediately filed a challenge to the rule.
