Tracker: State Legislation Regulating Use of AI in Healthcare Coverage Decisions
Major health insurance providers are increasingly using Artificial Intelligence (AI) to make decisions on whether or not to deny health care coverage. It is often unclear how AI makes these decisions and whether or how a human was involved in the process. The use of AI in these decisions has increased coverage denials — often wrongfully – leading to more people paying out of pocket or forgoing necessary, sometimes life-saving treatments.
State legislatures across the country are starting to pass urgently needed legislation to regulate the use of AI in healthcare coverage decisions. The table below illustrates where states have passed or are in the process of debating legislation to regulate AI in healthcare coverage decisions.
