WRNN-TV Associates v. Doe

Internet Free Speech — Right To Speak Anonymously
Case Description:

A television station filed a pre-litigation discovery proceeding seeking to identify the authors of comments on a message board that allegedly defamed a station executive, and the owner of the web site that contained the message board. After Public Citizen moved to quash the subpoena, arguing that the allegedly defamatory comments had not been specified and that the First Amendment protected the right to remain anonymous, the parties settled the case by the removal of the web site and the release of all claims against the web master, and but not against the anonymous posters.
