Limited Liability Company v. Jane Doe

Petitioner McConnell Valdes LLC filed a petition seeking review of an order of an intermediate appellate court of Puerto Rico denying discretionary review of an order of the trial court holding that the parties had not agreed to arbitrate claims arising from an employment relationship. Petitioner argues that the appellate court applied arbitration-specific Puerto Rico law and disregarded U.S. Supreme Court precedents under the Federal Arbitration Act (FAA).

On April 30, 2013, we filed a brief in opposition, arguing that the Court should deny the petition because the Court lacks jurisdiction to review decisions of the lower Puerto Rico courts and the trial court’s order is the operative decision, and because the trial court rejected petitioner’s argument regarding the scope of the arbitration clause based on generally applicable contract principles and not because of any judicial hostility towards arbitration. On June 10, 2013, the Court denied certiorari.
