Lisa Goodlin was injured by a defective pacemaker and brought suit against the pacemaker's manufacturer, Medtronic. Medtronic sought dismissal of the case, arguing that the Food, Drug, and Cosmetic Act expressly preempts state-law actions brought by patients who have been injured by medical devices that received premarket approval from the Food and Drug Administration. The U.S. Court of Appeals for the Eleventh Circuit agreed with us that Ms. Goodlon's claims were not preempted.
