First Amendment: Employee Speech
Joseph Densmore, a City of Maywood police officer, brought this case against the city and some of its employees for retaliating against him for exercising his First Amendment rights. The Court of Appeals found that there were disputed issues of material fact about the scope and content of Densmore’s job duties that precluded summary judgment. The defendants filed a petition for the Supreme Court to hear the case, claiming that there was a circuit split over whether the scope of a public employee's job duties is a question of law or a question of fact. Public Citizen was co-counsel for Densmore in opposing that petition, which was denied by the Supreme Court.
