Public Citizen believes that the escalating use of forced arbitration clauses in consumer and employment contracts is undermining the public’s ability to hold corporations accountable through the civil justice system and eroding the enforcement of basic civil rights and consumer protections. Most Americans are unaware that these clauses are buried in their cell phone, credit card, home building, nursing home, or employment contracts. The Litigation Group’s work complements Public Citizen’s legislative efforts on forced arbitration by fighting one-sided arbitration clauses and efforts to use arbitration clauses to ban class actions. We have argued significant arbitration cases in the U.S. Supreme Court, the federal appeals courts, and state courts.
