Sunoco, Inc. v. McDonald

Public Citizen Litigation Group assisted the respondents in this case. The question presented was:

Whether a state statute providing that an action for negligence may not be brought “more than 10 years after the act or omission complained of” establishes a “limitations period” that is subject to a provision in the Comprehensive Response, Compensation, and Liability Act, 42 U.S.C. § 9658, establishing a uniform discovery rule for the commencement of limitations periods applicable to state-law causes of action for personal injury or property damage resulting from the release of a hazardous substance, pollutant, or contaminant from a facility. The Court denied cert.
