After the lower courts found that Compton Unified School District had violated the Individuals with Disabilities Education Act (IDEA) by failing to identify a student with disabilities in need of special education services, the District filed a petition for certiorari asking the Supreme Court to consider a novel jurisdictional argument: Although the IDEA requires states to hear complaints “with respect to any matter relating to [] identification, evaluation, or educational placement,” the District proposed limiting jurisdiction to cases in which a school district affirmatively refuses to act on a specific proposal. We filed a brief in opposition, arguing that the District’s argument would make no difference on the facts of this case and was wrong as a matter of statutory interpretation. On January 9, 2012, the Court denied the petition.
