Public Citizen challenged New York's amended rules governing attorney advertising. The suit contended that that the rules allowed for arbitrary and discriminatory enforcement, prohibited noncommercial and commercial speech protected by the First Amendment, and ultimately harmed consumers by denying them access to information about their legal rights and available legal services. The district court declared most of the challenged rules unconstitutional and enjoined their enforcement. On appeal, the U.S. Court of Appeals for the Second Circuit affirmed.
