The Treasury Department is prohibited by law from funding the political activities of high level presidential appointees, and Office of Special Counsel (OSC), an independent federal agency, is responsible for enforcing that prohibition. Interested in Karl Rove's dual role as a government employee and political operative, Public Citizen, in January 2009, submitted a Freedom of Information Act request to OSC requesting all records in OSC's possession created on or after January 20, 2001, that concerned Mr. Rove. FOIA requires agencies to respond to FOIA requests within 20 working days, but eight years later, OSC had not responded to the request. The lawsuit sought an order compelling OSC to produce the requested records. After we sued, OSC produced records in response to the FOIA request.
