In this suit, Public Citizen and historical and librarian organizations challenged Archivist John Carlin's rule authorizing agencies to routinely delete electronic records from agency computers if a paper copy has been created. United States District Judge Paul L. Friedman ruled in favor of the plaintiffs in the District Court for the District of Columbia on October 22, 1997.

On August 6, 1999, the Court of Appeals for the District of Columbia Circuit reversed Judge Friedman's decision and upheld the Archivist's rule. Public Citizen and the United States Supreme Court denied further review.
