Description:
Which, if any, state law crop injury claims are preempted by the Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C. §§ 136-137? Public Citizen filed an amicus brief on the merits in the Supreme Court, arguing against preemption. The Court held in favor of the petitioner, concluding that the crop injury claims were not preempted by the Act.
