Dec. 4 - Public Citizen urges court to strike down FMCSA's hours-of-service rulePublic Citizen argues before the U.S. Court of Appeals for the District of Columbia Circuit today, asking the court to review the Federal Motor Carrier Safety Administration's (FMCSA) August 2005 hours-of-service rule. This rule lets truckers drive 77 hours in seven days or 88 hours in eight days, also allowing truckers to drive for 11 consecutive hours before taking a break. In 2004, Public Citizen successfully sued FMCSA over a similar rule created by the agency in 2003. The U.S. Court of Appeals struck down that rule because the agency did not consider its impact on truck driver health. The court also expressed doubts about the defensibility of the agency's decision to increase daily and weekly driving hours. Public Citizen will be arguing this case on Dec. 4, at 9:30 a.m. in the Court of Appeals Courtroom on the 5th floor of the E. Barrett Prettyman United States Courthouse, 333 Constitution Ave. NW, Washington, DC. Documents related to the Dec. 4 case are available here.
